Do you take the duty to consult seriously?

In difficult economic times, many companies are forced to restructure or consider mass redundancies. Particular caution is required here, as clear legal requirements apply in Switzerland - first and foremost the obligation to consult with employees, regulated in Article 335f ff. of the Swiss Code of Obligations (CO).

What does that mean in concrete terms?

The employees concerned or their representatives must be informed and consulted in good time before dismissals can be announced. The aim of this procedure is to work out solutions together in order to avoid redundancies as far as possible or to cushion their impact.

The consultation process is far more than a formal obligation. If implemented correctly, it can create trust, promote transparency and lead to better, more sustainable results. However, those who do not take this process seriously risk serious consequences. These include procedural errors, legal challenges and considerable additional financial burdens.
